Resumo

The present work explores the apparent opposition between confidentiality in Brazilian institutional commercial arbitration and the interest in disclosing the arbitration jurisdictional activity, especially with the aim of forming an arbitration jurisprudence. This research evaluates the outlines confidentiality in Brazilian institutional arbitration and the main reasons that lead this system’s users to consider it as advantageous. Likewise, it investigates the principle of publicity of the jurisdictional activity, identifying the main benefits of this publicity and the reasons that structure this social and general interests. When taking these elements into consideration, the analysis seeks to reconcile the appropriate content to attend the convenience of confidentiality, the interest on the arbitration jurisdictional activity and the formation of an arbitration jurisprudence. Taking into account that, in Brazil, the disclosure of arbitration decisions is insufficient to attend the social interests, this research intends to contribute with the improvement of this practice, aiming, also, the formation of an arbitration jurisprudence. The analysis offers criteria for the selection of content and data stratification, as well as recommends ways of disclosure and most appropriate formats for the dissemination of jurisdictional activity in order to benefit the formation of an arbitration case law.
