Resumo

This thesis examines how the concept of the unconstitutional state of affairs (ECI) has been invoked and applied by legal practitioners and by the Brazilian Supreme Court (STF) since its incorporation into Brazilian constitutional doctrine in ADPF No. 347. Using a qualitative and exploratory approach, the study analyzes initial petitions and plenary decisions in ADPFs and ADOs that reference or discuss the ECI, mapping its technical, rhetorical, and argumentative uses. Based on cases such as ADPFs 347, 635, 743, 760, 713, 782, 822 and ADO 59, the research demonstrates that the STF has not consolidated a stable jurisprudential framework: the concept operates in a hybrid fashion, sometimes as an exceptional adjudicatory technique grounded in the formal criteria established by the Colombian Constitutional Court, sometimes as a rhetorical device signaling the gravity of structural rights violations, and sometimes as a justificatory basis for structural remedies involving action plans, judicial monitoring, and intergovernmental coordination. The thesis concludes that the ECI remains an evolving, multifaceted instrument whose scope and stability depend on future doctrinal consolidation by the STF.
