Resumo

This study seeks to examine the constitutional limits of artistic freedom of expression in Brazil, with particular attention to the humoristic genre, highlighting the structural tension between the absolute prohibition of prior censorship and the need for effective protection against potentially harmful content. The legislative vacuum — resulting from the non-reception of the former Press Law in ADPF nº. 130 — has shifted to the Supreme Federal Court the task of defining, on a case-by-case basis, the boundaries of this freedom, as demonstrated by the cases analyzed. The research shows that, although prior censorship remains constitutionally forbidden, the establishment of clear legal parameters is essential to allow proportional precautionary measures aimed at removing content capable of causing irreparable harm. Appropriate regulation would help reduce legal uncertainty, balancing the protection of artistic freedom with the responsibility arising from its potential impacts.
