Resumo

The Federal Supreme Court was called upon to decide, in Extraordinary Appeals nos. 1,037,396 and 1,057,258, on the constitutionality of Article 19 of the Brazilian Internet Civil Framework, which conditions the civil liability of digital platforms on a prior judicial order for content removal. Research problem: this study examines to what extent the Supreme Court’s intervention reconfigures the institutional arrangement of regulatory governance over digital platforms and whether it is capable of ensuring sufficient protection of fundamental rights and democracy. Theoretical framework: the research is situated within the line “Regulatory Governance, Institutions and Justice”, combining the objective dimension of fundamental rights, the prohibition of insufficient protection, the theory of proportionality, and institutional models of self-regulation and meta-regulation, with emphasis on the Judiciary’s role in shaping regulatory arrangements. Method: the study adopts a bibliographical and case-law approach, with critical analysis of the Court’s opinions and binding theses, using inductive-deductive and hypothetical-deductive reasoning. It argues that, although the judicial decision introduces relevant procedural duties and institutional incentives, it remains provisional and limited, highlighting the need for legislative action to establish a stable and legitimate regulatory governance framework.
