Ministros do STF e a política pública da regulação das plataformas digitais

Resumo

Purpose – understanding the extramural activities of the Justices of the Federal Supreme Court and their interference in the public policy regulation of digital platforms. Research Design – explanatory research with content analysis of the records of the Justices’ participations in interviews and various events. Subsequently, a contextual analysis was carried out to compare the findings and highlight important points for future investigation. Findings – an essentially political activity was identified, stemming from the overarching influence of the Federal Supreme Court (STF) and its Justices in contemporary times. With early judgments, political opinions, and advocacy for better regulation alternatives, the Justices exert influence on public policy throughout various phases of its cycle. It was possible to classify the persona of each Justice in this role and summarize the narrative and solutions presented. Regarding contextual analysis, it was feasible to frame the analyzed content within a broader context of democracy advocacy and highlight the potential risks of explicitly adopting the theory of militant democracy. Practical contributions – the performance of the Justices was analyzed from various angles and with the assistance of various branches of knowledge. Therefore, the exploratory research generated insights and temporary conclusions instead of answering previous hypotheses. Social contributions – We shed light on important points about the governance of the STF and the political performance of the Justices, their characteristics, possible excesses, risks, and motivations. Originality – the exploratory nature of the study with exclusive focus on the extramural activities of the Justices, the identification of the inferred persona from the speeches, and the potential coalitions found.
