Resumo

Given the rise of the digital economy and its data-based businesses, competition policy is ever-more involved in the assessment of data-handling issues. The gathering, analysis, and commercial exploitation of data are core activities in this digital economy, constituting a valuable resource for the competitiveness of firms. This broadly applies to businesses organized as digital platforms, which use data as an input to refine and personalize its services and products. These organizations are at the frontline of ongoing cases and investigations, instigating public debate, academic research and legislative initiatives on data-related antitrust issues. As a result, authorities around the globe are conducting a series of initiatives to evaluate what are the potential competitive issues they may give rise and how to assess them. A number of recent reports have been published to tackle the issue. These reports gather proposals of remedies to competition policy, such as the development of codes of conduct, the adaptation of ex post competition rules, and the employment of data interoperability and data sharing. However, remedies designed to attend one policy goal may not be mutually adequate to resolve others. Thus, this dissertation aims assess what are the competitive issues related to exclusionary conducts in digital platforms and whether the proposed solutions found in current public initiatives are aligned with them.
