Resumo

The interruption of public works is one of the main obstacles to the efficiency of Public Administration in Brazil, generating significant impacts on the public treasury and the delivery of essential public policies. Law No. 14,133/2021, which instituted a new framework for public procurement, introduced important innovations regarding contractual guarantees, among which the performance bond with a step-in clause stands out. This clause allows the surety to assume the execution of the contract, either directly or through a third party, in the event of contractor default, thereby overcoming the previously dominant indemnity-based logic. This study aims to analyze the regulatory structure of the step-in clause under the new Public Procurement Law and to examine its pioneering implementation in the State of Mato Grosso, based on Public Notice No. 14/2024 and the contract for the paving of Highway MT-430. The research employs a legal-dogmatic approach combined with case study analysis. It concludes that the step-in clause represents a relevant reconfiguration in the regime of contractual guarantees, with potential to enhance contractual continuity and mitigate the effects of work stoppages, provided that its application is supported by a clear regulatory framework, economic balance, and institutional capacity of the parties involved.
