Resumo

This study seeks to understand how the public procurement process within the Government of the Federal District influences the effectiveness of public policies in the Federal District. As well as the implementation of the new Public Procurement Law and its main challenges, including the Preliminary Technical Study (PTS), the Annual Procurement Plan (APP), risk management, competitive dialogue, and the expansion of situations allowing direct contracting. Interviews were conducted with civil servants of the Government of the Federal District who are directly involved in procurement procedures. The participants answered a questionnaire regarding the implementation of the Law and its inherent challenges. Among the main findings, respondents perceive the procurement process as a highly legalistic and procedural mechanism, albeit one that incorporates certain innovations and, above all, consolidates previously fragmented legislation addressing the same regulatory subject matter. The study highlights innovations in planning instruments, transparency, and legal certainty, as well as the competitive dialogue procurement modality. However, the use of competitive dialogue remains limited due to several factors, including the complexity of its implementation, potential scrutiny by oversight bodies, and concerns among public managers regarding possible allegations of favoritism, in addition to other issues that still require greater understanding and institutional maturation.
