Considerações esportivo-jurídicas sobre o Regime Diferenciado de Contratações - RDC

Resumo

Brazil experienced a decade of intense activity in terms of the organization of international sports mega-events in the period from 2007 to 2016, in other words, starting off with the Rio 2007 Pan American Games and ending with the Rio 2016 Paralympic Games, which was the last event in the series. During this period that is commonly referred to as Brazilian sport’s “golden decade”, the Federal Government devoted itself to the task of organizing these events, which required an absolutely enormous amount of effort, given that the country's last experience with large multi-sports events had been in 1963, the year in which the Pan American Games were held in the City of São Paulo. Undergoing such an intense journey in such a short period of time required a series of measures on the part of the Federal Government in the sense of getting ready to fulfill its obligations in connection with the holding of the events in a range of responsibilities that covered everything from public safety to sport, visiting almost all the areas within the federal public administration. This paper highlights the creation of the Special Regime for Tenders as one of the innovations that was created in order to deal with the challenges posed and shows how this legislation’s conception includes a reminder of the difficulties imposed on the Brazilian State in the course of organizing sports mega-events, as well as making reference to the efforts to increase government capacity by expanding the management tools available to public sector administrators.
