Resumo

This dissertation analytically reconstructs the administrative and organizational effects of Direct Action of Unconstitutionality nº 2,135 on Brazilian public administration, with a particular focus on the prolonged suspension of the effects of Constitutional Amendment nº 19/1998. The central objective is to examine, from a historical perspective, how the injunction granted by the Federal Supreme Court—by reinstating the mandatory adoption of a single legal regime for more than two decades— reconfigured personnel management in the public sector and produced lasting institutional consequences. The research adopts a qualitative and exploratory approach, grounded in documentary analysis and a review of the specialized literature, examining constitutional texts, judicial decisions, and institutional documents related to administrative reforms and public management. The historical-institutional framework also operates as an analytical record of continuities, tensions, and ruptures in the organization of the Brazilian State, spanning from the 1936 Bureaucratic Reform to the judgment on the merits rendered in 2024 and the subsequent procedural closure of the case with the rejection of the motions for clarification (embargos de declaração) in August 2025. The dissertation concludes that the trajectory of Direct Action nº 2,135 reveals persistent challenges to administrative modernization, demonstrating how the interaction between politics, law, and institutions shapes public-sector personnel management policies in Brazil.
