Uma descrição da convivência entre portos com regimes jurídicos distintoso Porto Público de Itajaí e o Terminal Privado de Navegantes

Resumo

The present master's dissertation aims to describe the normative characteristics that fall on the Public Port of Itajaí and on the Private Port of Navegantes - one public under concession and the other private under authorization -, whose institutional coexistence was permitted by Federal Law No. 12,815 / 2013. I will therefore adopt the method of describing the normative particularities of each of the terminals. The analysis of the case is interesting in that both work with the same cargo profile (containerized); they are located in the same macrostructure as the access channel, turning basin and anchorages (opposite margins of the Itajaí-Açu River); and, in addition, they are controlled by important foreign groups that operate in the maritime transport segment. This dissertation intends to contribute to the understanding of the effects of this direct competition between the terminals subject to asymmetric regulation.
