Análise regulatória do transporte intermunicipal de passageiros por ônibus no estado de São Paulopropostas para aprimoramento à luz de experiências estaduais e do modelo federal

Resumo

In the last two decades, conventional intercity passenger transport by bus (TIPO) in the State of São Paulo has been negatively affected by the decline or stagnation of its main operational and financial indicators. Provided under the public service regime, the TIPO is subject to the imposition of restrictions on the entry of private individuals into the market – reserved for holders of concessions or permissions granted by bidding processes. However, since they became mandatory (with the enactment of the Federal Constitution of 1988), successive judicial disputes have prevented such tenders from being carried out, maintaining the status quo marked by a non-competitive environment that is increasingly less able to meet the needs of the population. In contrast, interstate passenger road transport (TRIP), regulated by the Federal Government, received approval from the Supreme Court (STF) in 2023 so that it could require only an authorization from private operators, giving the market the required stability to operate under a free market, with no limit on the number of companies and without the need to obtain a concession or permission as an enabling legal title to provide the service. The objective of this work is, through the combination of regulatory analysis and analysis of historical data (from TIPO, at the state level, and TRIP, at the federal level), to understand whether the regulatory regime to which TIPO is subject in the State of São Paulo can be considered as an impediment to the development of the market and to the fulfillment of the users’ interests and, if so, whether differentiated regulatory solutions could be adopted, such as, for example, migration or coexistence with the legal regime of regulated economic activity.
