Encampação da concessão da Linha Amarela no município do Rio de Janeiroum estudo de caso

Resumo

The central theme of this dissertation is the legal study of the encampment of public service concession through the analysis of the case of the Linha Amarela of the Municipality of Rio de Janeiro, especially regarding the compensation, its criteria and forms. The research is qualitative in nature and makes priority use of the inductive method - starting with the analysis of the case of the Linha Amarela to approach reflections on the encampment in general - and the phenomenological method - with the objective of assessing objective data from the case. The methods of observational and monographic procedure are adopted, based on documental (normative and jurisprudential) and bibliographic (doctrinal) sources. The work seeks to study the theme of compensation in cases of encampment. After an analysis focused on the chosen case, legal problems and reflections arising from the encampment in question were pointed out. By means of the survey and analysis of information throughout the research, it was possible to conclude that the objective criteria provided for in the Brazilian legislation are not sufficient to bring adequate legal security to the encampment. The administrative contract of public service concession could complement the legislation in order to ensure greater predictability, so as to bring more legal security to the encampment institute.
