Repensando o atendimento inicial nos Juizados Especiais Cíveis do Estado de Rondônia

Resumo

This dissertation has the aim to analyze the initial treatment provided to the parties, that is to say, perpetrator or defendant, under the Special Civil Courts of the State of Rondônia. The subject is highlighted in three parts: two are from theoretical evidence and the other one is completely practice. In the first case, it studies the access to justice and an effective prosecution as propositions that guide the court. The next stage is to make in a practical approach a comparative portrayal of Carioca and Rondoniense Special Civil Courts, exploring their specialties and recognizing the situations that are in trouble. In this chapter is the main subject of the project, which is to create a Sector of Initial Treatment destined to give support for the citizen, according to the article 9. º of the Law n. º 9.099/95 in cases up to 20 (twenty) minimum wage. The third and the last stage is targeted to a theoretical study, and it shows the SIT as a compulsory public policy by the Law Court in the State of Rondônia, showing the public civil suit and the adjustment term of a conduct as skillful instruments to impose it. The project followed didactic evidence, because it analyses issues of law and General Theory of Business Administration.
