Resumo

The aim of this study is to analyze the decisions of the Securities and Exchange Commission of Brazil “Comissão de Valores Mobiliários” (CVM) related to its evaluation of the relevance of family relationships linked to illicit acts committed in the capital market. The analysis of this issue is structured into two questions: (i) If family relationships are indeed relevant, in what context are they important? (ii) What is the legal consequence (evidence, proof that should not be refuted) and how was the family relationship qualified in the case (matter of evidence, presumption, or if it has already been previously evaluated as illicit)? The search method used keywords “father,” “son,” and “kinship relation” in the Turivus software - a jurisprudential research tool. As a result of this research, five votes were found. In conclusion, it was found that, in most cases, the relationship was valued as evidence for the consummation of the illicit act discussed in the respective vote, but the valuation of such relationship was not unanimous.
