Quais regras seguir em chamamentos públicos para Organizações Sociaiscríticas a partir de uma análise da jurisprudência do TCE/SP

Resumo

The present paper has the goal to indicate which regulation is applicable to the public procedure for partnerships with the third sector – specially the figure of the so called “Social Organizations” in Brazil – and to criticize the way the subject has been treated by a kind of external Government Accountability office that is the “Tribunal de Contas do Estado de São Paulo”. For this, it is use some theoretical references: a) many Brazilians Laws – specially the “Lei n. 9.637/98”; b) the Brazilian Supreme Court decision n. 1.423- DF; c) the decisions of the “Tribunal de Contas do Estado de São Paulo” according to the matter. The study shows that the “Tribunal de Contas de São Paulo” have being shaping the way the public procedures are made for a far more bureaucrat way – using for that a inapplicable law, “Lei 8.666/93”. Also, the essay shows that there are three sorts of municipal regulations of the subject in the state of São Paulo: a) the law is silent about how should be taken the public procedure; b) the ones which the law brings how shall be the process; c) the ones which says that the regulation has to be made by the Executive Branch of the Government Power. Therefore, the studies says the cases ‘a’ and ‘c’ shall be treater equally – the Executive Branch shall make the regulations; and the external control is to be made only about if the Executive Regulation it is objective and not personal – or if the regulations is observed by the public procedure.
