Resumo

In order to contribute to avoiding the launching of reckless administrative proceedings lacking the required probative robustness, this research work analyzed the concept of probable cause applicable to criminal action, used in the criminal procedural legislation as a requirement for launching the formal proceeding, its links with the degree of sufficiency of evidence of materiality and authorship as provided for in Law No. 12,529/2011, and its applicability and limits in the administrative sanctioning antitrust proceeding to investigate cartel conducts. The research included an analysis of the procedures of administrative investigation in the pre-processual stage, encompassing the scope and limits provided in the Brazilian antitrust law and the practice of Cade’s General Superintendence in carrying out investigative measures and the average duration of the procedures, through quantitative research of the 315 procedures initiated by Cade between 2015 and 2023. Additionally, the research involved qualitative analysis on the Cade’s precedents, examining the level of evidentiary filter that has been used for launching administrative proceedings and recent precedents that have shown a greater rigor in considering probable cause as a judgment of probability, rather than mere possibility, in order to limit the abuse of the right to charge.
