Resumo
Article 62 of the Constitution gives the Presidency of the Republic the power to use its decree power in case of urgency and relevance. This is recognized by the literature as the most expressive power available to presidents of the Republic. However, that assessment ignores that powers are disputed during the game of the Separation of Powers – in what we call conflicts about rules (as opposed to conflicts within the rules) and that can generate endogenous changes in the allocation of authorities between the political actors. Considering this fluid perspective of the Separation of Powers, this paper intends to demonstrate that weak presidents in a certain context can generate legacies of loss of powers for the office of the Presidency of the Republic – affecting the future presidents who will occupy the office.
