Os possíveis impactos do requisito de admissibilidade da relevância da questão de direito federal no recurso especial

Resumo

This paper analyzes the potential impacts of the introduction of the admissibility requirement of the relevance of the issue of federal law in special appeals, created by Constitutional Amendment 125/2022. The aim of the study is to examine whether the new requirement can effectively contribute to mitigating the overload of cases faced by the Superior Court of Justice since its creation, making it possible to increase the efficiency and quality of the Court's judicial provision. From a critical analysis based on statistical data and specialized doctrine, the paper investigates, based on a comparison with the requirement of general repercussion required in the admissibility examination of extraordinary appeals, which are the possible practical implications of the implementation of this new admissibility requirement for special appeals, with emphasis on the risks to the effectiveness of the institute that may arise from the way it will be regulated by the ordinary legislature.
