Resumo

This paper aims to analyze the decisions made by the Criminal Chambers of the Court of Justice of the State of Rio de Janeiro (TJ/RJ) during the year of 2024, regarding the calculation of the second phase of the penalty sentencing, specifically in relation to the application of the confession mitigating circumstance, whether it is made in a judicial or extrajudicial setting. Summary 545 of the Superior Court of Justice (STJ), published in 2015, states that "when the confession is used to form the judge's conviction, the defendant is entitled to the mitigating circumstance provided in Article 65, III, d, of the Penal Code." However, in a new jurisprudential update, through Informative 741 of the same Court, dated 2022, it was established that even if the confession is not used by the judge as the basis for the conviction, it must still be considered in the sentence when calculating the dosimetry. In light of this, it is noticeable that even after the publication of Informative 741, the Court of Justice of the State of Rio de Janeiro still issues decisions that are inconsistent with the new jurisprudence. In this context, the paper aims to observe the number of such decisions that diverged from the new - and necessary - understanding of the STJ regarding the confession in criminal proceedings.
