Os efeitos da insolvência sobre a arbitragemum estudo de direito comparado para um guia brasileiro

Resumo

This study aimed, from a theoretical standpoint, to map, categorize, and systematize the various effects of insolvency on arbitration, through a comparative law approach examining the treatment of the subject in Brazil, the United States, Europe, and Asia. The research was grounded on the survey initially conducted by the Arbitration and Insolvency Committee (2019) through the IBA Toolkit. The effects were categorized into jurisdictional, procedural, and substantive (merits-related) dimensions. From a practical perspective, an empirical analysis was conducted of the evolution of Brazilian case law on the matter, as well as of the applicable national legislation. From a normative standpoint, the study sets forth a practical guide for arbitrators, judges, and counsel, outlining the key considerations to be observed when the interface between insolvency and arbitration arises, across three distinct scenarios: (i) domestic insolvency versus domestic arbitration; (ii) domestic insolvency versus international arbitration; and (iii) international insolvency versus international arbitration.
