Os efeitos da insolvência transnacional nos procedimentos arbitrais

Resumo

This work seeks to examine the effects of cross-border insolvency – in the meaning of bankruptcy or recovery – on arbitral proceedings, within the context of globalization and internationalization of trade and business relations. Accordingly, we propose to study the consequences of cross-border insolvency with regard to the possibility of entering into an arbitration agreement by the debtor, the effectiveness of an arbitration agreement already concluded by the time of the insolvency and the endurance of ongoing arbitral proceedings. Furthermore, we will analyze the regulation of this subject, in a national and international perspective, as well as the conflict of laws originated by the suitability of several rules from different countries, typical of a cross-border insolvency outlook.
