Resumo

The contemporary debate regarding judicial institutions has produced polarizing positions regarding the issue of autonomy, either framing the current situation as an insufficient condition to the needs of judicial independence, or as an excessive situation that threatens the democratic legitimacy of the institutions, never explaining how the connection between autonomy and the observable results is formed. Stemming from organizational theory and the debate on agencies, this study frames autonomy as a multidimensional phenomenon, in which the combination of decision powers and instruments of control is frequently distributed in heterogenous fashion, to analyze the functioning of the Federal Justice of the 3rd Region (TRF3). By combining documental analysis, data analysis and interviews, a thick description is developed of the inner workings of the court, identifying the disposition of decision powers and instruments of control in both instances, as well as their relationship with the Federal Council of Justice (CJF) and the Executive Power. In this way, it aims to illustrate how the interaction of these dimensions can simultaneously produce both control and autonomy and highlight the potentialities of future comparative studies to identify the relation between types of control and autonomy and their possible effects in the functioning of organizations.
