A segurança jurídica desafiada pela atuação dos órgãos do sistema de controleuma análise à partir da formação do tema de repercussão geral n⁰ 0484 do STF

Resumo

The present work has the initial objective of analyzing whether Legal Certainty is guaranteed when there is an overlap in the performance of the Control System bodies, starting from a concrete case, the General Repercussion Theme n⁰ 0484, dealt with in RE n⁰ 650.898/RS, arising from the ADIn n⁰ 176236-45.2010.8.21.7000, proposed by the Public Prosecutor's Office of the State of Rio Grande do Sul against a Law of the Municipality of Alecrim/RS, which allowed the payment of a thirteenth salary and a constitutional third of vacation for political agents. At the same time, the Court of Auditors of the State of Rio Grande do Sul already judged the issues involving the theme in a favorable way for payment. After analyzing the decisions of the TCERS and the Direct Action of Unconstitutionality itself, it was identified that Legal Certainty was not guaranteed due to overlap and it was also identified that the performance of the Ministério Público was dissonant, not having its own members acted in a uniform way, creating legal uncertainty. Once it was identified that Legal Certainty was not guaranteed by the performance of the Control System, the analysis of the legislative measures mitigating the identified Control System dysfunctions that were taken in order to increase Legal Certainty was carried out.
