Resumo

The project of this dissertation was born from the perception of the potential impact of technological evolution in long-term contracts for the provision of public services. In this context, the objective of this dissertation is the practical and theoretical examination of the update and technological innovation of the object of the concession, based on the analysis of the contractual modeling adopted in the concession contracts that were signed in the 4th Round of the Concession Program of the road sector of the State of São Paulo, conducted by the Regulatory Agency of the State of São Paulo (ARTESP). The epicenter of this work is the examination of the contractual regulation of updating and technological innovation in the examined contracts, from the perspective of the legal order about how up to date are provided the delegated services, and the identification of the criteria that stimulate or limit the absorption of these updates and innovations throughout execution of long-term contracts. With this focus, after exposing the findings of the documentary research, the work presents the pertinent points researched from different perspectives, using modern national legal doctrine, state development functions, including the experience of the Brazilian energy sector, and also recommended international practices, which dialogue with these findings. The examination of the concessionary projects of ENTREVIAS, VIAPAULISTA and EixoSP (PiPa) demonstrated in the course of the reflections here exposed that, in addition to the undeniable advances of this successful state program, there are good practices that can be recommended to increase the promotion of research, development and technological innovation (R & D & I) in the São Paulo road sector and that can also be extended to other sectors, based on future specific studies
