Resumo
Purpose: The main objective of the research was to identify and analyze obstacles and challenges from the interpretation of managers, administrative inspectors and technicians of administrative contracts of the Brazilian Navy in the supervision of works in Military Organizations. Thus, the theoretical framework explores the broad concept of governance and its aspects, its management differentiation, as well as describes the contractual management process within the Brazilian federal public administration in the light of current legislation; in addition to verifying how the military organizations of the Brazilian Navy guide their agents responsible for the management and inspection of contracts. Methodology: The single, exploratory case study adopted a qualitative approach. For that, semi-structured interviews were carried out with managers, technical and administrative inspectors belonging to three Military Organizations of the Brazilian Navy. In addition, the research was also guided by bibliographic and documentary research, and electronic questionnaires applied to students of courses and lectures on the subject of management and inspection of administrative contracts. For the treatment of the research corpus, the MAXQDA-2022 software was used to help in the coding and categorization of data. Findings: From the results obtained by triangulating the data, through content analysis, it was possible to verify that the triad (manager, technical inspector and administrative inspector), when they know exactly their role of action, enhances the positive results of management and inspection. contractual. For this, professional improvement or specific training for the exercise of the position is essential. Regarding the inspection manual, it must receive the addition of the checklist to facilitate the performance of the manager/inspector who does not have an academic background compatible with the duties performed. In addition, the management and inspection of administrative contracts for works proved to be very dynamic, complex, composed of multidisciplinary and heterogeneous teams, and with little experience. Research limitations: The research corpus was restricted to the particularity of 03 (three) military organizations located in the State of Rio de Janeiro, which used the competitive bidding modality for the contracting of public works, after the entry into force of IN nº 05/2017 which deals with contracting services and lists the duties of managers, administrative inspectors and technical inspectors. Pratical implications: The challenges imposed on organizations due to the management and inspection of administrative contracts have been progressively debated in the Brazilian normative field, but in the academic world the subject is still incipient, especially when it comes to the inspection of public works. In this way, the advancement in this topic is intended to give greater clarity to the tasks carried out by the designated responsible agents, highlighting the importance of their roles in the execution and inspection of the contractual instrument, in order to ensure the perfect fulfillment of the administrative contract. Social implications: When taking into account the large amounts that government contracts represent in public finances, one can see the importance of understanding this dynamic and complex field of public contracts. With new laws and regulations and a policy aimed at modernizing public administration, the performance of these responsible agents is part of the search for efficiency, effectiveness and effectiveness of public resources. In this way, the research provokes a reflection on public governance and good management in administrative contracts. Originality: This work sheds light on a subject little debated in public administration, especially with regard to the management and inspection of public works. The originality lies in the locus of the research, which restricts its focus to three military organizations of the Brazilian Navy that Carrier out construction of public enterprises, in the period between 2018 and 2020.
