Resumo
This study aims to understand how agency problems are treated in the management contracts with Health Social Organizations by the State of Rio de Janeiro. For this, a literature revision is held allowing the construction of the theoretical framework, referring to the New Public Management and post-bureaucratic paradigm of hiring partnerships by the public sphere, identifying problems in contracting with focus on the agency problems. The context of this study describes, based on desk research, the field of analysis of the dissertation, a contract with Social Organizations by the Rio de Janeiro State Health Secretariat. The analysis of the results considering the agency theory perspective, applied to the content of the management contract and to the events of the context, leads to the conclusion that the Health Secretariat adopts on the delegation of management, in a standardized way, contractual safeguards that incorporate a large number of contingencies. Those identified as agency problems and exerts strong pressure as the principal of the relationship, imposing mandatory costs on agents as well as supporting control, monitoring and residual costs for the public party. It privileges consistent governance mechanisms, that include investment in information systems and the control and ongoing monitoring of contracts by dedicated organizational structure, with the behavior monitoring to achieve results linked to agent’s remuneration, without the use of incentives for rewards. There is no replacement of the classic means control by the purposes control claimed by managerial public administration. There is, rather, a dual control, in which accountability is an obligation and the results are an evaluation criterion for the transfer of resources and sustainability of the partnership, adding quality to public spending.
