Resumo

People who work in state or public interest activities are subject to a wide variety of legal regimes, which present different constraints on the management of people by the public administration. Most of these legal regimes are nonpermanent in nature – that is, there is no expectation of an indefinite duration of the employment relationship (for example, in the case of temporary workers). Legal literature, in general, has pointed out the existence of non-permanent work in the public sector as a patrimonial legacy, which would escape the constitutional rule of a single and statutory legal regime, or as an exception. The present work seeks to oppose this view, arguing that the strong presence of non-permanent work in the public sector is explained by the State's search for greater administrative autonomy in people management. In this sense, the varied legal personnel regimes represent legal human resources solutions with different degrees of autonomy for the administration to act in people management. From this, the work points out that such regimes have been adopted, to a considerable extent, as a strategy to obtain greater institutional performance by the State.
