Resumo
This work investigates the characteristics of contractual opportunism in the context of concession contracts, examining it from two perspectives: the theoretical elaboration of the characteristics and the application of an empirical test within the scope of the brazilian National Civil Aviation Agency (ANAC). With the materialization of the pandemic, contractual dynamics in the aviation sector underwent substantial changes, providing a unique opportunity to analyze how the parties involved react to crisis situations. The first part of the study proposes a comprehensive theory of contractual opportunism, highlighting the key elements that influence or enable opportunistic behaviors in contractual transactions. The second part carries out an empirical test, using data collected during the pandemic, to validate and refine the theory developed.
