Do que eu falo quando falo “liberdade de expressão”? Uma análise dos conceitos de “liberdade de expressão” na audiência pública sobre a constitucionalidade do art. 19 do Marco Civil da Internet

Resumo

This article aims to identify the meanings that the concept of "freedom of expression" took on in the statements made by representatives of institutions registered at the Supreme Court's public hearing on the 28th and 29th to judge the constitutionality of Article 19 of the Marco Civil da Internet, taking as premise that the concept of human rights is defined by discourse. After briefly presenting the Marco Civil da Internet and the debate surrounding the constitutionality of its Article 19, the article conducts a bibliographic survey to understand how academia understands the meanings of the right to freedom of expression in the Brazilian legal system and concludes with a study of how the main decisions of the Supremo Tribunal Federal on the subject reveal the concepts raised. Two main currents were identified: one that denotes the right to freedom of expression as prevailing over other fundamental rights, and another that understands that freedom of expression does not have greater axiological weight than other fundamental rights. With the survey conducted, we analyse, based on the transcript of the hearing held by the Instituto de Technologia e Sociedade, the statements made by the representatives of the institutions during the event, with the subsumption of the theories studied. The results of the research indicate that the debate on the constitutionality of the norm studied, at least at the level of the public hearing, involves the debate on the meaning of freedom of expression.
