Resumo

The right to be forgotten originates from the conflict between personality rights, such as the right to privacy, and the freedoms of expression and of the press. Although it is still a relatively new concept, there is already great discussion around this right, especially because it can manifest in different contexts and in various shapes - a situation that is only aggravated once one considers an online environment as well, which cannot be overlooked nowadays. This paper begins with an analysis of the fundamental rights in question, followed by an examination of how the idea of a "right to be forgotten" has developed in the United States (where the freedoms of speech tend to prevail) and in Europe (where there is a significant concern with privacy rights, especially in the context of personal data protection). From there, it seeks to understand if such a right might be compatible with the Brazilian legal system. Moreover, considering that the right to be forgotten demands an analysis of each case's facts, the paper proposes some criteria and parameters for such an assessment, founded on a study of already existing precedents from both Brazilian and international courts.
