Resumo

This paperwork analyzes criminal liability in the context of the crime of criminal organization, defined in Article 2nd of Law 12.850/2013. It begins by noting that the core verbs of the criminal provision – “promoting”, “establishing”, “financing”, and “participating” – are marked by semantic indeterminacy and create significant doctrinal challenges regarding objective criminality. The focus is on the act of “participating”, that is the individual considered a member of a criminal organization. To address this complexity, the paperwork adopts a teleological interpretation of criminal law, emphasizing the protection of the legal interest [translator's note: 'bem jurídico' is a civil law concept equivalent to 'legal interest' in common law] and the requirement of responsibility for one's own actions. In this approach, the dissertation contrasts two models of criminal liability in associative crimes: responsibility by transfer, which allows punishment based solely on membership in the organization, and responsibility for one's own actions, requiring specific individual conduct. The second model is chosen, adopting the criterion of control over the act (domínio do fato) [translator's note: a civil law doctrine similar to common law's notion of control over the act] to determine authorship. In this model, the individual's formal position is less important than whether their action independently increased the risk to the protected legal interest. The paperwork also analyzes the possibility, in Brazilian law, of complicity in the crime of criminal organization and comparable legal figures in foreign law. Furthermore, it reviews decisions of the National High Court in Brazil (STJ), demonstrating risks arising from inconsistent judicial interpretations and reinforcing the need for more consistent doctrinal criteria. Finally, it argues that only acts with concrete criminallaw relevance—that effectively compromises the protected legal interest—can validly support criminal liability.
