Competência do TCU para auditar contratações firmadas por empresa privada com participação estatal relevanteo caso da Norte Energia

Resumo

This research aimed to understand how the Federal Court of Accounts behaved in face of the investment made by Eletrobras and its subsidiaries in Norte Energia S.A, one of various companies in which Eletrobras has invested with the minority of the company’s shares. On this purpose, I conducted a survey of the Court of Accounts’s understanding about the existence of jurisdiction over companies with minority state investment, according to the state’s shareholding of the companies, to dialogue with the theoretical debate regarding the subject. During the preparation of the work, Eletrobras has been privatized and, despite my fear of losing the research’s purpose, which is the case study involving Norte Energia, the further steps of the discussion at the Federal Accounts Court showed up other nuances regarding the selfinterpretation of the Court’s jurisdiction. The exam of the understandings portrayed by the Court in the two moments of the procedure ended up enriching the discussion and showing an apparent antagonism between the Court's first and last positions, within the same case.
