Resumo

This study aims to verify the constitutionality of the Constitutional Amendment Proposition, hereinafter PEC, n 99/2011, currently under the National Congress analysis. This PEC proposes to concede nationally wide Religious Associations the right to propose judicial actions regarding constitutional matters. In order to enable the proposed study, the evolution regarding the brazilian concentrated control of constitutionality and the ratio to adopt the list of the legitimated parties, specially under the Constitution of the Federative Republic of Brazil of 1988, will be analyzed. Accordingly, it is necessary to initially analyze the Federal Supreme Court understanding and actions to reduce the number of lawsuits regarding the concentrated control and, then, understand the necessity of the inclusion of Religious Associations in the section 103 of the Brazilian Constitution. Further, it is also necessary to conceptualize the Derived Constitutional Power, seeking the limits of the constitutional amendments and analyzing if the aforementioned PEC violates any material limitation. As will be further analyzed, the mentioned PEC violates the State secularism and the individual rights granted by the Brazilian Constitution, such as equality, religious plurality and freedom of beliefs, all considered fundamental clauses of the Constitution, according to its section 60.
