Vontade do tribunal ou constituição generosa? Trazendo o constituinte para o debate sobre o controle de constitucionalidade preventivo

Resumo

One of the answers given to the expansion of the powers of the Brazilian Supreme Court holds the Constituent Assembly responsible for the powers given to the Court. The objective of this work is to prove that the STF takes for itself competences never handed for constituent, even on matters in which the omission of other powers cannot be alleged. For that, we study the preventive control of amendments making a comparative analysis between its drawing in the Assembly and the changes that occurred along the jurisprudence of the Court.
