Aspectos não penais da Lei Maria da Penhaa indenização das vítimas de violência doméstica no âmbito cível

Resumo

The following aimed to analyze the understanding of the Court of Justice of São Paulo about the possibility of compensation for moral damages of women who were victims of domestic violence in cases in which the criminal justice did not find the defendant guilty but did not deny the occurrence of the fact. Therefore, I analyzed ruling dated from March 2018 to March 2019. These were divided into several categories, which resulted in the production of numerical data. Hypotheses were also raised about the cycle of the abusive relationship in order to elucidate the data obtained. Finally, we proceeded to the analysis of three selected cases, to understand the approach given by the magistrates in relation to the subject. Unfortunately, it has been found that women in situations of violence have very restricted access to civil protection, which undermines access to justice as a whole.
