Resumo

For decades, the national and international legal community has discussed whether the arbitration award can be annulled or in any way revised by a state judge based on misinterpretation or disregard, by the arbitrators, of the law applicable to the resolution of the dispute. In the United States of America, this topic has been the subject of doctrinal and jurisprudential controversy since at least the 1950s. In Brazil, in turn, Law No. 9,307/1996, known as the Arbitration Law, establishes very restricted hypotheses for annulment of the arbitration award by the Judiciary. None of them allows state judges, at least not expressly, to overturn the arbitrators' decision based on alleged disregard of the law, even if manifest. In this context, this thesis, initially, aims to investigate whether the jurisprudence of the São Paulo Court of Justice, the largest court in the country, admits any form of review of an arbitral award by the Judiciary based on the arbitrators' disregard or misinterpretation of the applicable law. Concluding that the jurisprudence of the São Paulo Court of Justice allows the annulment of an arbitral award for violation of public policy, even in the absence of an express provision in the Arbitration Law, we identify a scenario for the annulment of the arbitrators' decision by the Judiciary due to manifest disregard of the law. Subsequently, the thesis turns to the jurisprudence of the Federal Supreme Court and the Superior Court of Justice, seeking to identify the understanding of these higher courts regarding the notion of public policy. In the end, the thesis draws parallels between the results of the analysis of the jurisprudence from the São Paulo Court of Justice and the Federal Supreme Court/Superior Court of Justice, summarizing the research findings and providing the reader with some sort of indicative "guide" of the issues that, according to the examined jurisprudence, may lead to the annulment of an arbitral award for violation of public policy, or in other words, for manifest disregard of the law.
