Resumo

This paper presents an analysis of the time barring of claims for compensation for police lethality. Thus, a contextualization of police violence in Brazil and the difficulties of victims' relatives to obtain their right to compensation is exposed. The fact that some of the actions are considered time-barred is one of the reasons that make it impossible to grant the actions and to analyze the facts and legal arguments raised by the parties. The time bar usually occurs when the relatives of the victims wait for the end of the police inquiry before filing a lawsuit in the civil sphere. Four theses applicable to the cases were identified: (i) the three-year statute of limitations provided in the Civil Code; (ii) the five-year statute of limitations counted from the date of the fact; (iii) the five-year statute of limitations counted from the filing of the inquiry; and (iv) the imprescriptibly of fundamental rights. The analysis of the cases showed that there is still much divergence within the judiciary as to which rules and interpretations are applicable to these cases, generating strong legal uncertainty.
