A natureza da relação entre o SUS e as instituições privadas que prestam serviços públicos de saúdeelementos para a constituição da rede de ações e serviços públicos de saúde

Resumo

The federative entities, especially the Municipalities, face many difficulties in ensuring the provision of health services that are adequate to the population's demands. These difficulties arise from the way these services are financed and budgeted; and from obstacles raised by various actors, especially the various branches of the Public Prosecutor's Office and the Courts of Auditors. The research question to be answered is what is the nature of the relationship between the SUS and the private institutions that provide health services to it? Is there a correspondence between the nature of this relationship and the normative instruments used to formalize this public-private relationship? The main hypothesis adopted in this study is that the use by the federative entities of the instruments available for the incorporation of health services into their own network or as complementary services to the public health system presents a mismatch between form and content, which implies the use of adjustments that are not appropriate to the form of participation in the SUS – complementary or indirect execution. We conclude that, regardless of the adjustment used, the relationship between the SUS and the private institutions that participate in it by providing health services indirectly or in a complementary manner is a contractual relationship that imposes obligations on both parties and we list the available adjustments – administrative contract, agreement and management contract – for the incorporation of health actions and services into the network itself or complementary to those offered by it, the forms of participation in the SUS, the possible objects for the adjustments and the private institutions that can sign them.
