A homologação no Brasil de sentença arbitral estrangeira anulada na sede

Resumo

In December 2015, Brazilian courts were faced, for the first time, with the decision of whether a foreign arbitral award vacated at the arbitral seat could be recognized by the Brazilian Superior Court of Justice. The content of the decision raises the question if it would be possible, in certain cases, for Brazilian courts to recognize and enforce a foreign arbitral award annulled in its place of origin. This is a relevant discussion in terms of effectiveness and enforceability of arbitral awards that might have to produce effects in other jurisdictions and also of the extent to which international arbitration is bound to the arbitral seat. In order to answer this question, the present thesis will be analyzed in the framework of international conventions on the matter and of decision experiences in other countries, to then, in light of the Brazilian legal system, understand to what extent Brazilian courts could recognize and enforce vacated arbitral awards.
