Resumo

his paper analyzes the expansion of the victim's role in the investigative phase of the Brazilian criminal prosecution, problematizing the tensions between the revalorization of the offended party and the guarantees of the investigated. It starts from the historical evolution which, after the state monopolization of justice and the consequent marginalization of the victim, culminated in their rediscovery as a subject of rights by the 1988 Constitution and international regulations. The study examines the inquisitorial nature of the police inquiry, traditionally devoid of full contradictory proceedings, and contrasts this model with the recent jurisprudential trend of the Supreme Federal Court and the Superior Court of Justice, which have admitted figures such as the assistant to the prosecution in the pre-procedural phase and victim intervention in the police inquiry. From the perspective of penal guaranteeism, this expansion is criticized when unaccompanied by legal safeguards, warning of risks to the equality of arms, violation of the presumption of innocence, and subversion of the Public Prosecutor's role as the exclusive holder of the penal action. It is concluded that the necessary protection of the victim implies strictly respecting the limits of the accusatory system.
