(Re)lembrar e (re)descobriruma análise dos tipos penais de sodomia dos séculos XVI e XVII através de lentes contemporâneas

Resumo

This project departs from the story of Xica Manicongo — who was posthumously recognized as the first transgender person in Brazilian history — to investigate the legal provisions that persecuted her at the end of the 16th century. It proposes a contemporary analysis of the criminal norms that condemned sodomy under the Ordenações Manuelinas and Filipinas, aiming to explore a potential historical link between the repression of homosexual and transgender individuals and the persistence of discriminatory systems that continue to impact Brazilian society today. The goal is to recover and critically examine the legal mechanisms used to persecute LGBTQIA+ lives in the 16th and 17th centuries, in order to reflect on the symbolic and social effects of these practices — both in their historical context and in the present, where Brazil continues to rank as the country with the highest number of LGBTQIA+ homicides worldwide.
