Responsabilidade penal de dirigentes por acidente de trabalho à luz da imputação objetiva

Resumo

The research aims to analyze the criminal liability arising from a work accident with a typical result, within the company. In this context, it is not uncommon to impute the result to the managers of the company based on the formal corporate designation or business organization chart, without evaluating, with due attention, the assumptions of criminal punishability. To better illustrate the problem, we brought three concrete cases and the dogmatic related to the matter, with its resolution, at the end, through the German Gutachtenstil method, whose purpose will be to respond to the inquiry affirming or denying the punishability of the elected agent. The theory of objective imputation will be the focus of the study, based on the principle of ROXIN risk, with the analysis of the requirements: creation of a legally disapproved risk, realization of this risk in the result and scope of the type. We will also analyze the occurrence of the violation of a technical standard of work safety and the objective duty of care, elements of the culpable crime, as well as whether the victim's behavior contributed to the harmful result, or if there was a hypothesis of self-placement in danger. The present study intends, therefore, to demonstrate the importance of the theory of objective imputation in the solution of crimes that occurred in the labor activity, offenses characterized as result crimes, particularly with regardc to the identification of criminal liability.
