Resumo

The study aims to explore the hypotheses formulated by authors who studied the phenomenon of litigation, more specifically about what influences the parties to reach an agreement or go to trial, using qualitative research with the agents of the procedure of article 334 CPC, limited to the context of Rio de Janeiro. In the first chapter, the provision of article 334 CPC, which establishes a conciliation or mediation hearing in the initial phase of the procedure, and the characteristics and objectives of the procedures will be addressed. In the second chapter, the Economic Analysis of Litigation and the hypotheses that impact the choices of individuals in making an agreement will be presented. At the end of the second chapter, it will be possible to conclude that it is more efficient for society and for individuals to make an agreement. In the third chapter, qualitative research and its considerations will be presented. The conclusion of the work is to explore the hypotheses mentioned by the literature bringing them to the Brazilian context, and to serve as inspiration for future works on the subject.
