Resumo

This dissertation analyzes the correlation between the legal framework of attorney’s fees imposed on the losing party and the phenomenon of litigiousness in the Brazilian civil procedural system, with emphasis on the economic incentives generated by the current model. The research adopts an exploratory, descriptive, and explanatory methodology, based on bibliographic review, legal and case law analysis, as well as empirical data on judicialization. Its objective is to assess whether attorney’s fees for the losing party — especially when combined with legal aid and the exclusive entitlement of fees by the prevailing party’s counsel — operate as a deterrent or as a stimulus to litigiousness, including frivolous litigation. The first chapter examines the origin, evolution, and legal foundations of attorney’s fees in Brazil and in comparative law. The second chapter analyzes the economic, normative, and institutional factors that influence procedural behavior, with emphasis on agency theory. The third chapter articulates the previous findings to critically evaluate the effectiveness of attorney’s fees as a mechanism for regulating litigiousness. It concludes that the current model, by reducing the plaintiff’s financial risk and enhancing the lawyer’s incentives, contributes to increased judicialization, revealing contradictions between the normative structure and the goals of balance and efficiency in the justice system.
