Modificação da estrutura de incentivos no direito penalevidência da implementação inicial do acordo de não persecução penal na Justiça Federal

Resumo

The purpose of this dissertation is to verify, empirically, the effect of introducing ANPP in the caseload of Brazilian’s Federal Judicial System. Specifically, a quantitative approach was developed to investigate the magnitude of the impact of ANPP’s implementation on the percentage of charges filed by the Brazilian Federal Prosecution Service. It is a study with a regulatory focus, which uses economic tools to examine a legal institute. Through a regression analysis, based on data on the number of charges filled and cases dismissed by the Brazilian Federal Prosecution Service, between the years 2012 and 2020, it is examined whether the current legal configuration of the ANPP is efficient to encourage the negotiated resolution of criminal conflicts and the corresponding decongestion of the justice system. The results indicate that after the introduction of the ANPP there was an average reduction in the percentage of monthly charges filed of 6.22%, considering the national scene. Examination of the specific situation of each federative unit reveals a certain heterogeneity in behavior, with a greater reduction in the percentage of charges filed being identified in locations with fewer cases. In conclusion, the ANPP is pointed out as an inefficient instrument to the decongestion of the justice system.
