Resumo
This study seeks to investigate how it is possible to improve the objectives of environmental conservation and public use associated with protected areas in Brazil through the concession of services in protected areas. The National System of Conservation Units in Brazil (SNUC), established by Federal Law 9,985/2000, indicates two major objectives to be achieved with the creation of protected areas: environmental conservation and public use. Data analyzed throughout this study indicate that the objectives of public use are not effectively achieved, within the scope of the management of protected areas. At the same time, the legislation on protected areas admits that environmental agencies responsible for their management promote partnerships with the private sector in order to better achieving the objectives of the SNUC. Among the admitted partnerships, the concession of services stands out. In the scenario of protected areas in Brazil, however, the instrument of the concession is underused in the management of protected areas. The results of this study indicate that the concession is a fit and effective instrument to enable the objective of public use to be promoted according to the objective of environmental conservation, which is elementary and priority. Besides the possibility to develop a legal-financial model that, based on governance, encourages the private agent (concessionaire) to adopt measures in the name of the social benefit associated with protected areas (and not just in the name of profit), the concession itself can also be useful to overcome inherent difficulties associated to the management of protected areas, such as the restriction of resources (financial and human), the lack of a culture of belonging in relation to protected areas, the long geographic distances that make more difficult the pubic visitation or the lack of basic infrastructure.
