Resumo

The dissertation research involves structuring a new methodology for the Public Prosecutor Office in the collective protection of public security. To this end, the work begins by discussing public security as a social right, in contrast to the traditional conception, focusing on police repression and punishment. In doing so, the main legal and sociological issues that affect public safety will be highlighted. The objective is to have elements so that public security as a social right is the foundation of collective protection of public security. With this, it was possible to structure the Public Prosecutor's Office's activities along five fundamental axes: prevention, repression, victim’s attention, external control of police activity and the prison system. Next, the normative production regarding the topic of collective protection will be seen, with the CNMP as the development center, as well as the first experiences of internal specialization: specialized groups of special action (GAESP's) and specialized prosecutors' offices. Finally, the final part of the dissertation explores the new proposed methodology, through the qualified use of data. To this end, the work carried out by the 14th Public Prosecutor's Office of Chapecó/SC will be presented, showing how a database of homicides, robberies and sexual abuses was constructed, unifying police and judicial data, with ample possibility of disaggregating variables. From this data, two techniques will be used, demonstrating the potential and importance of the existence of a structured database for public security. The first is the analysis of the flow of the criminal justice system, through which the clearance and punishment rates can be extracted, in addition to visualizing the average processing times. With this, bottlenecks in the criminal justice system can be identified, which allows the Prosecutor Office to act to reduce existing structural impunity. The second technique is the analysis of criminal public policy, through which the public policy cycle is used to think about the actions of the Public Prosecutor's Office in the face of concrete security problems. The example developed will look at public policies for preventing and repressing violence against women. At the end, a summary of the proposed methodology is offered.
