Resumo

The purpose of this paper is to analyze the actions of the Federal Supreme Court in relation to the concentrated control actions filed against Law 14.701/2023 to discuss indigenous territorial issues. The study addresses a contextual presentation of the current moment of Brazil's so-called transformative constitutionalism in order to identify the difficulties in implementing the indigenous rights guaranteed by the 1988 Constitution. Having identified a scenario of mismatch and non-conformity between the actions of the Three Branches of the Republic, it discusses the “recent” emergence of structural processes, their assumptions, mechanisms and difficulties. Finally, the study presents a critical view of the STF's handling of these cases, concluding that the imposition of structural techniques in direct actions of unconstitutionality, direct actions of unconstitutionality by omission and declaratory actions of constitutionality generates even greater inconsistencies. We therefore suggest a rethink about the appropriateness of structural actions in the Court, so that the advantages brought by the institute are not eroded by its misuse.
