Resumo

The author comments on the new scope of Brazilian social security resulting from the Federal Constitution of 1988, analyzing, from the standpoint of social justice, the privileged situation of certain professional groups, protected by specific criteria or even by particular systems of security as concerns their right to retirement. Based on data informing about income and age of superannuated people, he points out social iniquities remaining in force even within the jurisdiction of the Sinpas (National System of Social Security and Welfare), and emphasizes the two major types existing now for retirement - by right of age or of time of service which traditionally benefit different segments of the people, due to socio-economic characteristics of the workers. Thus, professional people belonging to brackets of high income and oriund from classified positions in large State enterprises, or in oligopolic sectors of the economy generally retire on basis of time of service, while low income workers, pertaining to undeveloped or competitive economic areas, as well as to sectors of the informal economy, can only obtain their pensions on basis of old age, after an extra journey of 12 years, or more.
